How Are Drug Charges Determined in Ohio?

A drug crime conviction in Ohio can have severe consequences, including fines and prison time. However, under Ohio law, not all drug crimes are charged equally.

What Determines How a Drug Charge Is Charged?

In fact, there are several factors that determine how a particular drug crime is charged, including:

  • Type of drug
  • Amount of drug
  • Intent of the defendant
  • Age of the defendant

If you are facing drug charges in Ohio, please review the summary of each of these factors below and contact our Ohio criminal defense attorney to begin planning your defense.

Type of Drug

The first factor that can impact a drug charge is the type of drug involved. In Ohio, drugs are categorized by schedule, with the lowest schedule containing the most dangerous drugs. Generally speaking, the lower the schedule, the more serious the drug charge.

Amount of Drug

The second factor that impacts a drug charge's severity is the total amount of drugs involved. This is typically determined by weight. So, as the weight of the drugs discovered on a person increases, so do the associated charges.

Intent of the Defendant

A defendant's intended use of drugs found in his or her possession is an important factor in determining drug charges. Charges for personal use tend to be less severe than charges for the sale of illegal drugs.

Age of the Defendant

The age of a defendant can also impact the drug crimes with which he or she is charged. For example, a minor arrested for possession of a drug will probably not face the same charges and penalties as an adult arrested for possession of the same drug. In addition, the age of the individual purchasing drugs can potentially impact the seller's charges. Selling drugs to a minor will probably result in harsher charges than selling drugs to an adult.
